Website Terms and Conditions

Effective Date: July 1, 2026

The Club HBCU Student Excellence Fund™ (“Fund”) is administered by Cups Are Great™, a subsidiary of The Funding Profiler, LLC (“Institution,” “we,” “our,” or “us”). These Terms and Conditions govern participation in the Student Excellence Fund™ and use of the Student Excellence Profile™, grant application process, and related services available through the Club HBCU website.

By accessing this website, submitting a Student Excellence Profile™, or participating in the Student Excellence Fund™, you acknowledge that you have read, understood, and agree to these Terms and Conditions.


1. Purpose of the Program

The Club HBCU Student Excellence Fund™ was established to support educational opportunity for eligible students attending accredited Historically Black Colleges and Universities (“HBCUs”) through educational grants administered in accordance with the Institution’s published governance policies and available funding.

Participation in the program does not create any contractual right to receive funding.


2. Eligibility

To be considered for an educational grant, an applicant must satisfy the published eligibility requirements for the applicable grant cycle.

Unless otherwise announced by the Institution, applicants must:

  • Be accepted for admission to or actively enrolled at an accredited Historically Black College or University located in the United States.
  • Be pursuing a bachelor’s, master’s, or doctoral degree.
  • Complete the Student Excellence Profile™.
  • Provide documentation reasonably requested to verify eligibility.
  • Remain eligible through the award disbursement process.

Students enrolled solely in associate degree programs are not eligible.

The Institution reserves the right to modify eligibility requirements prospectively for future grant cycles.


3. No Purchase Required

No purchase or payment is required to submit a Student Excellence Profile™ or to be considered for an educational grant.

Purchasing products from Cups Are Great™ helps support the Student Excellence Fund™ but does not increase or decrease an applicant’s opportunity to receive a grant.


4. Student Excellence Profile™

Submission of a Student Excellence Profile™ indicates an applicant’s interest in participating in the Student Excellence Fund™.

Submitting a profile does not:

  • Guarantee eligibility.
  • Guarantee selection.
  • Guarantee receipt of funding.
  • Create a contractual relationship with the Institution.

Applicants are responsible for ensuring that all submitted information is complete and accurate.


5. Applicant Identification Number

After submission of a Student Excellence Profile™, applicants may receive a unique Applicant Identification Number.

This number is used solely for administrative purposes and does not indicate eligibility, priority, or selection.


6. Eligibility Verification

The Institution reserves the right to verify any information submitted by an applicant.

Verification may include:

  • Enrollment confirmation.
  • Admission verification.
  • Degree program verification.
  • Identity verification.
  • Communication with the applicant’s educational institution.
  • Additional documentation reasonably necessary to administer the program.

Failure to provide requested information may result in an applicant being determined ineligible for the applicable grant cycle.


7. Recipient Selection

Only applicants who successfully complete eligibility verification will participate in the documented random selection process.

Recipients are selected through a documented random selection methodology designed to provide every verified eligible applicant with an equitable opportunity for consideration.

Selection is not influenced by:

  • Purchases.
  • Donations.
  • Sponsorships.
  • Personal relationships.
  • Social media activity.
  • Customer status.
  • Political affiliation.
  • Any factor other than published eligibility requirements.

Recipient selection decisions are final except in cases of administrative error, fraud, or verified ineligibility.


8. Educational Grants

Awards provided through the Student Excellence Fund™ are educational grants.

Educational grants:

  • Are not loans.
  • Do not require repayment under normal circumstances.
  • Do not create future entitlement.
  • Are not compensation for employment or services.

Award amounts are determined by available funding and the Institution’s stewardship responsibilities.

The Institution does not guarantee that grants will be awarded during every grant cycle.


9. Payment of Awards

Whenever reasonably practicable, educational grants will be paid directly to the recipient’s accredited HBCU for application to the student’s institutional account.

Funds are intended to support educational expenses, including:

  • Tuition.
  • Mandatory fees.
  • Housing.
  • Meal plans.
  • Books.
  • Other educational expenses administered through the student’s institutional account.

If a recipient becomes ineligible before funds are applied, the Institution may request the return of unused funds from the educational institution, consistent with applicable law and institutional policy.


10. Grant Cycles

The Institution currently administers multiple grant cycles throughout the academic year, including Fall, Spring, and Summer.

The Institution reserves the right to modify:

  • Application periods.
  • Deadlines.
  • Announcement dates.
  • Award schedules.
  • Grant cycle administration.

Changes may occur without prior notice when reasonably necessary.


11. Privacy

The Institution respects the privacy of all applicants.

Personal information is collected solely for the administration of the Student Excellence Fund™ and related communications authorized by the applicant.

The Institution will make reasonable efforts to protect confidential information and will not knowingly disclose private information except:

  • As authorized by the applicant.
  • As necessary to administer the program.
  • As required by law.

12. Publicity

Recipients may be invited to participate in promotional or educational materials highlighting the impact of the Student Excellence Fund™.

Participation is voluntary.

Applicants who decline publicity opportunities remain eligible for educational grants.


13. Transparency

Although the Student Excellence Fund™ is administered by a privately owned company, the Institution voluntarily publishes transparency information to strengthen public trust.

Transparency reports may include:

  • Number of applicants.
  • Number of verified applicants.
  • Number of grants awarded.
  • Educational institutions represented.
  • Financial stewardship summaries.
  • Program impact statistics.

Personally identifiable student information will not be published without appropriate authorization.


14. Communications

By submitting a Student Excellence Profile™, applicants consent to receive communications related to the administration of the Student Excellence Fund™.

Applicants who separately opt in may also receive marketing communications from Cups Are Great™.

Applicants may unsubscribe from marketing communications at any time.

Administrative communications regarding the grant program may continue as reasonably necessary.


15. Fraud and Misrepresentation

Providing false, misleading, incomplete, or fraudulent information may result in:

  • Disqualification.
  • Withdrawal of an award.
  • Permanent removal from the program.
  • Other actions permitted by law.

The Institution reserves the right to investigate suspected fraud or misuse.


16. Limitation of Liability

To the fullest extent permitted by law, the Institution, Cups Are Great™, The Funding Profiler, LLC, and their affiliates, officers, employees, contractors, volunteers, and advisors shall not be liable for indirect, incidental, consequential, or special damages arising from participation in the Student Excellence Fund™ or use of this website.

Nothing in these Terms limits liability where prohibited by applicable law.


17. Changes to the Program

The Institution reserves the right to modify, suspend, or discontinue any aspect of the Student Excellence Fund™ at any time.

Such changes may include:

  • Eligibility requirements.
  • Award amounts.
  • Grant cycle schedules.
  • Administrative procedures.
  • Website content.
  • Program documentation.

Changes shall not affect grants already approved unless required by law or necessary to address fraud or material ineligibility.


18. Intellectual Property

The names “Club HBCU Student Excellence Fund™,” “Student Excellence Profile™,” “Sip Happiness. Support Excellence. Build Legacy.™,” and related logos, branding, content, graphics, and materials are the intellectual property of Cups Are Great™ and/or The Funding Profiler, LLC unless otherwise indicated.

No content may be copied, reproduced, or used without prior written permission.


19. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws applicable to The Funding Profiler, LLC, without regard to conflict-of-law principles, except where superseded by applicable federal law.
